Motion to dismiss Black Elk child neglect case

Bismarck, North Dakota – A move has been made by the Burleigh County State’s Attorney to drop the child neglect prosecution against a woman from Bismarck.

After first entering a guilty plea to child negligence in connection with her baby’s murder last year, Cassandra Black Elk received an 18-month prison sentence.

However, subsequent autopsy results showed that the child’s death was classified as an unexpected, abrupt death.

The Supreme Court of North Dakota maintained the district judge’s decision to give Black Elk a second chance at trial, stating that she was given incorrect guidance before entering a guilty plea.

At this point, a judge must sign the request to dismiss.
